Waiver of Liability

I, for myself, my personal representatives, or heirs, hereby release Bonnie and Clyde Urban Tours and Marie Claire Gagnier (hereafter referred to as "BaCUT"), their representatives, employees, affiliates, or tour guides (hereafter “Staff”) from liability from all claims related to personal injury, illnesses, accidents, death, property loss, or any other grievance, arising from participation on any of their tour, activity, event, even if due to negligence of BaCUT or Staff.

Risk of Tour

​

I understand the Tour involves walking on unfamiliar roads, uneven old stone streets and walls, alleyways, stairways, and busy streets. I hereby accept any risk of tripping, slipping, and falling before, during, or up to 24 hours after a Tour. I voluntarily assume full responsibility for the risks of touring under the influence of alcohol and for my behavior and health.  I agree not to hold BaCUT, its Staff, or the hosting brewery/restaurant/facility/drinking and eating location liable in any way should any harm come to me.

Assumption of Risk

I understand that BaCUT is acting as an agent in arranging tours and services, and does not assume liability for accidents, delays, injuries, loss or damage due to any act of mine, or any brewery/restaurant/facility/drinking and eating location that the tour visits. I acknowledge that my participation in the Tour is voluntarily. I ASSUME FULL RESPONSIBILITY for any risk of loss, personal injury, including death that may be sustained by me and any loss or damage to my property, as a result of participation in the Tour, even if due to negligence of the BaCUT Staff, to the fullest extent allowed by law.

Consumption of Alcohol

I acknowledge that the Tour involves the consumption of alcohol. I declare that I am over the legal drinking age in Greece of 18 years old.  I acknowledge the potential dangers associated with the consumption of alcohol, such as injury and even death, and I voluntarily participate, knowing that it may be hazardous to my property and me. I also acknowledge that it is my responsibility NOT TO BECOME INTOXICATED during the Tour, and that BaCUT is not responsible if I become intoxicated. I take full responsibility for any liability associated with my intoxication, during or after the Tour. I acknowledge that BaCUT assumes no liability for injuries that may occur to me or others, and no liability for any civil or criminal violation that may be brought against me as a result of my being intoxicated before, during or after the Tour.

Food and Allergies​

​

BaCUT is not responsible for any food allergies or sickness caused by the consumption of the food and beverages offered on their Tour. As a participant, I am responsible for my own health and for determining whether certain foods and beverages are safe for me to consume. I acknowledge that it is my own responsibility to inform the tour operator BaCUT  or Staff of any special dietary needs or allergies.

VEHICLE TRANSPORTATION / for Eat & Crete food tour​

I understand and acknowledge that the Tour involves transportation by a motorized vehicle, including, but not limited to van or car transportation. I acknowledge and understand the inherent risks associated with these methods of transportation and acknowledge that I do not have any medical condition(s) that would prevent me from being transported in such vehicles, or result in any injury or harm in using these methods of transportation. I understand and agree that BaCUT will exercise ordinary and reasonable care in the operation of any motor vehicle used for transit on the Tour.

Behaviour​

​

Openly rude, hateful, disrespectful, abusive or violent behaviour will not be tolerated at any time, to other guests, local population, animals, nature or towards staff of BaCUT or its Staff or collaborators. People from all different walks of life are welcome with us.  Discrimination against any person, based on race, religion, colour, gender, sexual orientation, age, national origin, disability or any other status or condition protected by law will not be tolerated.  BaCUT's tours and activities are meant to be fun and respectful.

Such inappropriate behaviour with or without intoxication from any guests will result in a warning given from the BaCUT Staff.  If the behaviour continues, BaCUT reserves the right ask these guests to leave the tour.  In such cases no refunds will be awarded.

CHILDREN & BABIES​

​

As much as we do love kids, our tours and entertainment value are truly geared toward an adult audience.  Guests can not bring children and babies with them.  If you wish to book a tour with together with your children, we are happy to arrange a Private Tour instead; send an email to clyde@bonnieandclydeurbantours.com.

PETS & ANIMALS​

​

Pets and animals can not be brought on the tours. We love all kinds of pets, but this is a tour for people.  Thanks for your understanding.

Photo and Video Release

​

I am aware that images or recordings may be taken during the course of a Tour.  I grant BaCUT permission to the rights of my image, recording, likeness and/or sound of my voice as recorded on a Tour, without payment or other consideration on their social media platforms and website.  Guests reserve the right not to be filmed, photographed or recorded.  If this is your wish, please state this clearly to your tour guide in person.  We value our guests’ right to privacy.

right to privacy & anonymity

​

Guests reserve the right to their anonymity once the tour is completed, by submitting a written request to  cs@bonnieandclydeurbantours.com. Guests may ask for their other personal data to be deleted (email, phone number, date of birth, nationality, anniversaries, dietary preferences, health issues and other information collected upon booking).  Please note that we may need to retain certain information for recordkeeping purposes or to complete transactions, or when required by law.  BaCUT will process these requests within 30 days of receiving the formal email request.

TOUR CANCELLATIONS​

​

BaCUT runs their tours rain or shine.  In case of extreme weather conditions or unforeseen conditions including low guest participation, BaCUT reserves the right to cancel their tours.  Customers will receive a written notification before the tour start time and full refund or credit.  Guests are responsible for checking their inbox, mobiles, applications, etc. for messages.

Acknowledgement of Understanding

​

I have read and understood this Guest Waiver of Liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to pursue legal action. I acknowledge that I am making this agreement freely and voluntarily, and intend by my purchasing, booking or reserving a ticket(s) or reservation(s) to completely and unconditionally release Bonnie and Clyde Urban Tours and Marie Claire Gagnier and Staff of all liability to the greatest extent allowed by law.
